By using DropScam you agree to these Terms and acknowledge the Privacy Policy.

2. Eligibility

You must have the legal capacity to enter into these Terms and use the app responsibly.

 

3. Description of Service

DropScam provides educational scam-risk analysis and guidance. It is not a law enforcement, legal, financial, cybersecurity, or emergency response service.

 

4. Important Safety Notice

DropScam assists users in recognizing potential scams but cannot guarantee detection, prevention, or accuracy in every circumstance. Users remain responsible for their own decisions.

 

5. User Responsibilities

You agree to use DropScam lawfully and represent that you have the legal right to submit any messages, screenshots, photographs, or other content you ask DropScam to analyze.

 

6. Device Permissions

Certain features require access to your camera, photos, notifications, or contacts. You control these permissions through your device settings.

 

7. Trusted Contacts

By adding a Trusted Contact, you represent and warrant that you have obtained that person's consent to provide their contact information for this purpose.

 

8. Device Messaging

Trusted Contact notifications and Emergency Alerts use your device's native messaging capabilities. DropScam is not a telecommunications provider, does not monitor personal SMS conversations, and cannot guarantee message delivery. Carrier or data charges may apply.

 

9. Emergency Alerts

Emergency features are designed to assist communication but are not a substitute for calling 911 or local emergency services.

 

10. Subscriptions and Billing

Paid subscriptions are purchased and managed through Apple. Billing, renewals, cancellations, refunds, and payment processing are handled under Apple's policies.

 

11. Free Plan Limitations

Free-plan scan limits may be enforced using anonymous technical identifiers to prevent abuse.

 

12. Results History

Results History functions according to the selected subscription level and user-controlled sharing options.

 

13. Reset App

Reset App removes user data stored by the app on the device but does not reset free-plan scan counts maintained to enforce plan limits.

 

14. Intellectual Property

The DropScam software, trademarks, logos, and content are protected intellectual property.

 

15. Third-Party Services

DropScam relies on certain third-party services including Apple platform services. Their availability and policies are outside DropScam's control.

 

16. Privacy

Your use of DropScam is also governed by the DropScam Privacy Policy.

 

17. Disclaimer of Warranties

The service is provided 'AS IS' and 'AS AVAILABLE' to the fullest extent permitted by law.

 

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DROPSCAM, LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REVENUE, OR FINANCIAL LOSSES RESULTING FROM AN UNDETECTED SCAM. DROPSCAM'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO DROPSCAM DURING THE SIX MONTHS BEFORE THE CLAIM OR (B) US$50.

 

19. No Continuous Detection Guarantee

Scam techniques continually evolve. Although DropScam is updated regularly, newly emerging scams may not be immediately recognized. Users should not rely solely on the app when making financial or personal decisions.

 

20. Indemnification

You agree to indemnify DropScam for claims arising from misuse of the service or violation of these Terms.

 

21. Suspension or Termination

DropScam may suspend or terminate access for misuse, fraud prevention, or legal compliance.

 

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia. Before arbitration, both parties agree to make a good-faith effort to resolve disputes informally in writing. Unresolved disputes shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Both parties waive participation in class or representative actions. Any arbitration or court proceeding permitted by law shall occur in Atlanta, Georgia.

 

23. Changes to these Terms

DropScam may update these Terms as the service evolves. Material changes will be communicated as appropriate.
